Fruity cargo cult Apple can’t get rid of a bribery case where it is alleged that it tried to obtain Carry Concealed Weapon (CCW) gun licenses for iPads.

In California, you may not carry a concealed firearm on your person in public, unless you have a valid Carry Concealed Weapon (CCW) license. These are rarely given in the county where Apple is located.

However, if the prosecutors are correct, Thomas Moyer, Apple's head of global security really wanted to arm his teams and approached the Santa Clara County undersheriff to provide the paperwork.

In 2016 and early 2017 Moyer were apparently receiving serious threats against Tim Cook, Apple's CEO, and became concerned about its ability to respond to these threats without carrying hidden lethal boom boom sticks.

The undersheriff asked for a donation of iPads to the Santa Clara County Sheriff's Office in exchange for releasing concealed carry weapon licenses and Moyer agreed. This was a little odd as Apple had no established programme for donating products to law enforcement agencies, and the Sheriff's Office had no need for iPads particularly the 200 iPads suggested.

The trial court dismissed the bribery count claiming that Moyer’s actions were not enough to constitute a bribe. However, the appeals court has now reversed that decision and said that “consistent with the Ninth Circuit's interpretation of California law, federal law and the law in many states, we conclude that such a promise may constitute a bribe.”

“We also conclude that the evidence presented to the grand jury was sufficient to raise a reasonable suspicion of such bribery. Accordingly, we reverse the trial court's order dismissing the bribery count against Moyer, reinstate that count, and remand for further proceedings,”
